- Not be located in a prohibited jurisdiction

- • Loss of private keys means permanent loss of assets

9.2 Cap on Liability
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
- • $5 USD; OR
- • FEES PAID BY YOU in the 12 months preceding the claim
9.3 Exceptions
Limitations may not apply to:
- • Death or personal injury caused by negligence
- • Fraud or fraudulent misrepresentation
- • Breaches of implied terms that cannot be excluded by law
10. Indemnification
You agree to defend, indemnify, and hold harmless Soulforge Origins, its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

- • Violation of any rights of third parties
- • Your User Content
- • Your tax obligations
- • Your NFT transactions or ownership claims
- • Your negligence or willful misconduct
11. Intellectual Property Policy (DMCA)

To report copyright infringement, provide:

13. Account Termination

14. Dispute Resolution

Before formal proceedings, parties agree to attempt resolution through good faith negotiations for 30 days.
14.2 Binding Arbitration
Disputes not resolved informally shall be resolved through binding arbitration under American Arbitration Association Commercial Rules inWyoming, United States.
14.3 Class Action Waiver
YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.
14.4 Exceptions
The following may be brought in court:
- • Small claims court actions
- • Injunctive relief for IP infringement
- • Claims not subject to arbitration under applicable law
14.5 Time Limitation
Claims must be brought within one (1) year of when the claim arose.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Wyoming, United States, without regard to conflict of law principles. Exclusive jurisdiction for disputes not subject to arbitration: courts of Wyoming, United States.
16. General Provisions

These Terms and Privacy Policy constitute the entire agreement between parties.

If any provision is invalid, the remainder continues in full effect.
16.3 No Waiver
Failure to enforce any provision is not a waiver.
16.4 Assignment
We may assign these Terms. You may not assign without written consent.
16.5 Force Majeure
No liability for delays or failures due to circumstances beyond reasonable control.
16.6 Relationship
Nothing creates partnership, joint venture, agency, or employment relationship.
